Everything you need to know about international arbitration on one page

International arbitration is a very tricky area, there are too many peculiarities so that even an academic course in this field is only a small amount of knowledge that the practitioner should have. We are often asked by young lawyers starting their practice in arbitration about the general information that could help them to have a general picture of what is arbitration.important about arbitration1 Everything you need to know about international arbitration on one page

The young practitioners need an overview of arbitration or rather basic information presented in clear order on such issues as description of arbitration,   advantages of arbitration, kinds of disputes that can be arbitrated,   the agreement to arbitrate, comparing ad hoc to institutional arbitration, international arbitration rules and international and regional arbitration institutions.

Another hot issue where lawyers facing arbitration need at least basic information is drafting the arbitration clause, and with that respect it is important to have examples of model clauses and clearly understand what are elements of an arbitration agreement.

To have full picture a practitioner must be knowledgeable about   enforcement of arbitral awards (court enforcement of arbitral awards, conventions for the enforcement of arbitral awards and grounds for refusal to enforce arbitral awards). Specific area is resolution of investment disputes through arbitration, in particular, under the ICSID rules.

All written above is presented with the only aim to highly recommend the paper “International Arbitration” prepared by Ms Kathryn Helne Nickerson under auspices of OCC-IC that provides a very useful overview of international arbitration related issues. The document is available for reading here.
